Terms of Service

1. Who you are dealing with
TutorFlow (“the Service”) is operated by Artemii Berko, an individual doing business as a sole proprietor in Ontario, Canada (“we”, “us”). These Terms are a contract between you and us. By opening the TutorFlow bot, using the cabinet or paying for a subscription you agree to them. If you do not agree, do not use the Service.
2. What the Service is
TutorFlow is a software tool for private tutors who teach one-to-one. It gives a tutor a Telegram bot under their own name where their students book lessons, keeps the count of lessons a student has paid the tutor for, and sends reminders before lessons.
TutorFlow is not a marketplace. It does not list tutors, find students, rate lessons or take part in the arrangement between a tutor and a student. Lesson fees are agreed and paid between the tutor and the student outside the Service; TutorFlow never receives, holds or transfers them. The only payment made through the Service is the tutor’s own subscription for the software.
3. Your account
- The Service is used through Telegram; your Telegram account is your TutorFlow account. You are responsible for everything done from it.
- You must be at least 18 years old, or the age of majority where you live, to subscribe.
- Information you enter about yourself must be accurate and kept up to date.
- If you add students, you confirm that you are entitled to enter their details and to let us process them on your behalf as described in the Privacy Policy. Where a student is a minor, obtaining any consent required by the law of your country is your responsibility.
4. Subscription and payment
- Every new account has free access for 3 months from sign-up.
- After that, access is bought for a term of 1, 6 or 12 months at the prices shown in the cabinet and on the pricing section. Prices are in US dollars. Tax is added at checkout at the rate of the buyer’s country.
- Nothing renews automatically. A paid term is added to your access once; when it ends, you decide whether to buy another.
- When access ends, the cabinet becomes read-only: you can see your students, lessons and balances, but not change them, and your students cannot book. Buying a new term restores full access; your data is not deleted.
- Card payments are processed by Paddle.com Market Limited or Paddle.com Inc. (“Paddle”), acting as merchant of record. Paddle is the seller of record for those purchases, collects the applicable tax and issues the receipt; Paddle’s Buyer Terms apply to the purchase itself.
- Payments in Telegram Stars are made inside Telegram under Telegram’s own terms. Cryptocurrency payments are made through a payment page of a third-party processor; for these you buy directly from us.
- Refunds are described in the Refund Policy.
5. Acceptable use
You must not:
- use the Service for anything unlawful, or to send spam or fraudulent messages;
- infringe anyone’s intellectual property or privacy;
- interfere with the security or operation of the Service — probe, scan, overload or circumvent its limits, or introduce malware;
- copy, scrape, resell or redistribute the Service, or reverse-engineer it;
- use the Service to harass or harm your students or anyone else.
6. Your content and our property
Everything you and your students enter — student details, schedules, notes — remains yours. You grant us a licence to store and process it only to provide the Service to you. The Service itself — its software, design, texts and the TutorFlow name — belongs to us and stays ours; you receive a non-exclusive, non-transferable right to use it for the purpose it is built for, within your plan.
7. Availability
We work to keep the Service available, but we do not guarantee that it will run without interruption or errors. It depends on Telegram and on our hosting providers, which we do not control. Reminders and notifications can be delayed or fail to arrive; keep your own record of anything critical.
8. Suspension and termination
We may suspend or end your access if you:
- materially breach these Terms, or repeatedly or seriously violate the acceptable-use rules;
- create a security or fraud risk for the Service or its users;
- let your subscription lapse — in which case access becomes read-only as described above.
You can stop using the Service at any time. On request we delete your account and its data; see the Privacy Policy for what we must keep and for how long.
9. Disclaimer and limitation of liability
The Service is provided “as is”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, incidental or consequential loss — including lost profits, lost lessons or lost data. Our total liability to you for all claims arising from the Service is limited to the amount you paid us for it in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence.
10. Changes to these Terms
We may update these Terms. Material changes are announced in the TutorFlow bot at least 14 days before they take effect. Using the Service after that date means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-law rules. Disputes are brought before the courts of Ontario, unless the consumer-protection law of your country of residence gives you the right to bring them elsewhere.
